These Terms of Service (“Terms”) govern your access to and use of afterdarkquick.com (the “Site”) and the alcohol delivery service operated by After Dark Quick (“we,” “us,” or “our”). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site or our service.
1. Eligibility
You must be at least 19 years of age (the legal drinking age in Ontario) to use this Site or to place an order. By using the Site, you confirm that you meet this age requirement and that any delivery you arrange will be received by an adult of legal drinking age. Valid government-issued photo ID is required at the point of delivery.
2. Ordering and delivery
- Orders are placed by phone or text. We do not accept online ordering at this time.
- All orders are subject to product availability, delivery zone, and the driver being able to confirm a valid delivery address within our service area.
- Estimated delivery times (ETAs) are quoted at the time of the call and are best-effort estimates only. Traffic, weather, and order volume can extend actual delivery times.
- We reserve the right to refuse any order — including, without limitation, where the recipient is intoxicated, unable to produce valid 19+ photo ID, located outside our service area, or where we suspect the order is for resale or for someone underage.
3. Pricing and payment
Prices are quoted in Canadian dollars at the time you place your order. Payment is collected on delivery and may be made by cash, debit, credit card, or e-transfer. We do not store payment-card details on the Site. Receipts are provided on request.
4. Refunds, returns, and cancellations
Once a delivery has been completed and accepted, all sales are final, except where the product is defective or not as described — in which case please contact us promptly so we can resolve the issue. Orders may be cancelled at no charge before the driver has been dispatched; once a driver is en route, a cancellation fee may apply at our discretion.
5. Responsible service
We follow the requirements of the Alcohol and Gaming Commission of Ontario (AGCO) and applicable provincial law. We will not deliver to anyone who appears intoxicated, who cannot produce valid 19+ photo ID, or where we have reasonable grounds to believe the alcohol will be supplied to a minor. We encourage every customer to drink responsibly and to never drink and drive.
6. Acceptable use of the site
You agree not to:
- Use the Site for any unlawful purpose
- Misrepresent your age, identity, or delivery address
- Interfere with or disrupt the Site or its servers (for example, by submitting automated requests, scraping, or attempting to bypass security)
- Copy, reproduce, or redistribute Site content (text, photography, brand marks) without our written permission
7. Intellectual property
The Site and its content — including the After Dark Quick name, logo, copy, and photography — are the property of After Dark Quick or its licensors and are protected by Canadian and international copyright and trade-mark law. Brand names of bottles we sell remain the property of their respective owners and are shown for product identification only.
8. Third-party links and services
The Site may link to third-party websites or rely on third-party services (hosting, email delivery, payment processing). We are not responsible for the content or practices of those third parties; their use is governed by their own terms.
9. Limitation of liability
To the maximum extent permitted by law, After Dark Quick is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our service. Our total liability for any claim arising out of or related to the Site or any order shall not exceed the amount you paid for that specific order.
10. Disclaimer
The Site is provided “as is” and “as available” without warranties of any kind, express or implied. We make reasonable efforts to keep product details, pricing, and delivery information accurate, but we do not warrant that the Site will be error-free or uninterrupted.
11. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-laws principles. Any dispute arising under these Terms will be resolved in the courts of Ontario, and you consent to their exclusive jurisdiction.
12. Changes to these terms
We may update these Terms from time to time. The “Last updated” date at the top of this page reflects the current version. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
